Terms & Conditions

We are VAT registered. VAT Number 437 0023 32.


From here on within this document the use of “we”, “us” or “the business” refers to Marlin Mechanical Ltd.

The following Terms and Conditions apply to any business conducted with us.


1. Work Conducted:

We will be polite and courteous and honest in all of our dealing and expect the same curtsy from our customers. We reserve the right to refuse service for any legally valid reason. Reasons may include: if we are unable to conduct the work in the required time, equipment is deemed to be unsafe or not viably repairable, previous abuse/non-payment, requested work may damage our image or may be considered illegal.



2. Listed Prices:

The current up-to-date price list is held on our website and we reserve the right to change listed prices when it becomes necessary with no notice. All listed prices are exclusive of parts cost. Any price listed as “from” is to be considered a guide and although we attempt to stick to these guide prices a quote should be requested to confirm the correct cost.


 

3. Parts: 

We order parts from various suppliers using a cost vs quality vs lead time matrix. We endeavour to fit genuine parts where possible. We have a twice weekly delivery that is free of charge. If the parts are required quicker, we can order on a Next Day Delivery*, and will pass a £5 delivery charge onto the customer for express service.


We do not hold many spare parts in stock and as such some items are ordered as required. Any parts ordered for work that is subsequently cancelled will incur a handling fee and the customer will also be liable to pay the full value of the part if not returnable. 


*We are unable to guarantee a next day delivery as that is down to the shipping company that our suppliers decide to use.



4. Customer Supplied Parts:

 We are happy to fit parts supplied by the customer, however the customer will be liable for the warranty of the parts and any disposal of the old items. The customer will be required to sign a liability form. We will still cover the 3 months labour warranty. We do reserve the right to refuse fitting customer parts at our discretion.



5. Quotations:

For equipment brought to us at our workshop, there is a quotation fee of £20. If you proceed with the quoted work, we will deduct the £20 fee from your overall invoice.


For off-site quotations, there is a fee of £30. If you live up to 5 miles of our location and proceed with the quoted work, we will deduct £20 from the overall invoice. If you live up to 10miles of our location and proceed with the quoted work, we will deduct £10 from the overall fee.


Quotations are valid for 28 days. We will honour the labour charge stated for that time on the quotation. However, we are unable to guarantee the price of parts quoted due to the volatile industry. We will endeavour to let the customer know of any significant increase in price.



6. Call-Outs, Travel Time, Collection and Delivery: 

A call out is considered on site work.

We do not charge a call out fee for work carried out 5 miles or under from our workshop.

We do charge a call out fee of £10 if you are over 5 miles from our workshop.

We will charge a minimum rate of 1 hour at our hourly rate (not including the call out charge).

We reserve the right to charge travelling time at our standard rate of £55 + VAT per hour. The decision to charge travelling will be based on travel time, work to be undertaken and costs.

We provide a collection and delivery service for some equipment requiring service or repair. There may be a charge for this service, please see the collection and delivery page of our website for more information.


 

7. Timescales: 

 We always try to give an accurate estimation of the time a repair of service will take. However, sometimes events outside our control may cause this to increase and we will endeavor to let you know as soon as possible.



8. Sales of Goods and Services:

 All goods and spare parts remain property of the business until full payment has been received whether they have been fitted or not.

 Our standard terms are cash on delivery/collection of equipment. Some customers requiring long-term/major/reoccurring work may be offered 30 days for the duration of the work at our discretion.

  All invoices must be paid within the terms stated; failure to do so will result in the customer being immediately placed on stop and all works whether in progress or future planned will cease. Any customer placed on stop repeatedly or for more that 14 days will risk being blacklisted from our services. Any invoice(s) overdue by 90 days will result in legal action being taken to recover the owed amount. 



9. Second Hand Equipment:

We occasionally offer second hand equipment for sale. This equipment at a minimum has been through our workshop for checks, cleaning and a service. Some equipment will have undergone major repairs. All equipment sold will come with a 3 months parts and labour warranty. 


10. Warranties:

 Our work is covered by one of the following internal warranties. 


Parts and Labour: We warranty repairs and services for a minimum of 3 months from the date of work. We will conduct a free of charge repair if any part we fit fails or our labour is at fault. We will not cover the cost of independent inspection or repair unless it is conclusively proven that it was an issue caused by negligence on our part and we have previously agreed.


Labour only: For customer supplied parts, we offer 3 months labour warranty from the date of work. We will conduct a free of charge repair if our original labour is at fault. Should it be the customer supplied part at fault, our labour will be charged at our current hourly rate. We will not cover the cost of independent inspection or repair unless it is conclusively proven that it was an issue caused by negligence on our part.


New Equipment: Warranties on new equipment sold are determined by the manufacturer. 


Second hand equipment: We offer a 3 months warranty from date of sale on all second hand equipment we sell. This covers parts and labour up to 75% of the value of the equipment. We may at our discretion offer a partial or full refund of the purchase price depending on overall condition, usage and time owned.

Our second hand equipment warranty only covers NON-COMMERCIAL use unless sold on trade terms as indicated on the purchase invoice.


What Is Not Covered: Our warranties do not cover damage, abuse of equipment, wear of wearing parts or service items requiring replacement. We will replace wearing parts and service parts if failure is caused by a defect of manufacturing or our labour e.g. we will not replace a worn out belt free of charge but we will replace a new belt that we supplied and fitted if it fails when new.
